Terms and Conditions

The LEADpiper website, lead distribution system, and services (collectively, the "Site") are provided by Purplewire, LLC ("Purplewire") and are accessed by you ("User") under the terms described in this agreement. Purplewire reserves the right to modify this agreement at any time by notifying User by email or by posting a notice on the Site.

ACCESS TO SERVICE Purplewire will provide access to the Site as soon as User registers and agrees to the terms of this agreement. The agreement will continue to be in effect, and Purplewire will continue to provide access to the Site, until the the agreement is terminated by notification by either party, or via failure of User to pay any required fees, or by breach of the agreement.

SITE CONTENT The trademarks, brands, and logos used on the site are the property of Purplewire and may not be used without permission. The design, content, code, graphics, and layout of the Site ("Content") are the property of Purplewire. User may not use, copy, or create derivative works based on the Content without expressed permission of Purplewire.

Purplewire does not claim any rights to content posted to the Site by User. Our usage and handling of this content is covered under our Privacy Policy

FEES AND PAYMENT Some usage of the Site requires User to pay ongoing fees. User shall pay all fees for services described on the Site and as selected by the User. Such fees are non-refundable. Purplewire reserves the right to change fees or institute new fees at any time with prior notice to User via email or by posting on the Site. Terms are Net 30, and failure to pay within the term constitutes default of this agreement.

USAGE RESTRICTIONS User agrees not to take any of the following actions

• post any obscene, defamatory, threatening, or otherwise objectionable content
• attempt to bypass any security features of the Site
• use another user's account, or attempt to acquire another user's password
• share User's password with other people outside their immediate workgroup, whether users of the system or not
• use the Site to send unsolicited emails ("spam")
• use any automated method of accessing the site other than those described in an API document published by Purplewire.
• take any action which consumes an unreasonably high load on the Site's infrastructure.
• impersonate another user
• intentionally post a computer virus other harmful computer code
• collect information from the Site for any purpose unrelated to the use of the Site
• register multiple times for purpose of acquiring additional free introductory credits
• provide false or misleading information during registration or when applying for monthly billing

INDEMNIFICATION User will indemnify and hold Purplewire, its parents, subsidiaries, affiliates, officers and employees, harmless, including costs and attorneys' fees, from any claim or demand made by any third party due to or arising out of User's access to the Site, use of the Services, the violation of this Agreement by User, or the infringement by User, or any third party using the User's account, of any intellectual property or other right of any person or entity.

DISCLAIMER OF WARRANTY THE SERVICES, CONTENT, SITE AND ANY SOFTWARE ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE

TERMINATION Either party may terminate this agreement at any time via notification by any means. Purplewire may terminate the agreement at any time and disable User's account if User violates any of the terms (including the payment terms and usage restrictions as outlined above) of this agreement.
